Republic of Heat Terms of Use & Sale

These terms cover user accounts, subscriptions, gift subscriptions, and one-time purchases with Republic of Heat.

I. Account Terms

These terms govern creating and using a user account ("Account") on republicofheat.com, operated by Austin & Gardner GbR. They apply alongside our Privacy Policy, the Shipping & Returns policy, and any event-specific or privacy notices.

1. Provider and Scope: Austin & Gardner GbR, doing business as Republic of Heat, Südostallee 124, 12487 Berlin, Germany. VAT ID: DE457184736. Contact: contact@republicofheat.com.

2. Eligibility and Registration: You must be at least 18 years old, provide accurate information, and choose a secure password. Only one account may exist per person.

3. Purpose of the Account: Your account lets you manage orders, reviews, and personal settings (e.g., heat level or delivery address).

4. Community Conduct: Stay respectful and avoid discriminatory, offensive, or unlawful content as well as spam or advertising.

5. Event Creation and Participation: When creating events you confirm you are authorised to run them and comply with applicable regulations.

6. User Duties: No false information, no technical tampering, and no misuse. Notify us immediately if you suspect unauthorised use.

7. Account Deletion and Termination: You can delete your account at any time. Data is removed in line with our Privacy Policy unless statutory retention obligations apply.

8. Platform Availability and Changes: We aim for high availability but cannot guarantee it. Maintenance or updates may limit functionality.

9. Liability: Republic of Heat is liable only for intent or gross negligence. For slight negligence we are liable only for breaches of essential contractual obligations.

10. Privacy: Data is processed under our Privacy Policy. We work with providers such as Stripe, Customer.io, Google Analytics, and EU-based hosting partners.

11. Changes to These Terms: Republic of Heat may adjust these terms when legal or technical requirements change.

12. Governing Law and Venue: German law applies. The courts of Berlin have jurisdiction where legally permissible.

II. Gift Box Terms

1. Nature and Validity: Gift boxes are one-time purchases.

2. Transferability: Gift boxes are intended for the named recipient.

3. Redemption and Expiry: Gift codes can be redeemed within 12 months of purchase.

4. Refunds and Withdrawal: Gift boxes are non-refundable once shipped. Before shipping, the 14-day withdrawal right applies.

5. Responsibility of the Giver: The purchaser must provide accurate recipient details. Republic of Heat is not liable for incorrect information.

IV. One-Time Purchase & E-Commerce Terms

1. Contract Formation and Payment: A purchase contract is formed when you place an order and we confirm by email. Payment is due in advance, e.g., via Stripe, credit card, or PayPal.

2. Shipping and Delivery Time: We typically dispatch within 3 to 5 business days using DHL or similar carriers. Tracking details are emailed to you.

3. Transfer of Risk and Transport Damage: Risk transfers only upon delivery to you (§446 German Civil Code). Report visible damage within 48 hours and include photos.

4. Returns and Withdrawal: You have 14 days from receipt to withdraw. Email contact@republicofheat.com; we refund within 14 days of inspecting the return.

7. Retention of title: Goods remain the property of Republic of Heat until paid in full.

V. Online Dispute Resolution and Consumer Mediation

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
